New Delhi: The special CBI court has started hearing against all the accused including former Communication Minister A Raja in the 2G spectrum allocation case under the charges of Section 409 of IPC (Criminal breach of trust). Ironically, the CBI was not in mood to slap section 409 of IPC against the accused.

The Public Prosecutor UU Lalit without informing the investigation agency had argued before the court to slap Section 409 of IPC against the accused of 2G spectrum allocation case. Following which the court accepted the plea and framed the charges.

Section 409 IPC carries a maximum punishment of imprisonment for life.

CBI official said, “The probe agency had slapped only Section 420 of IPC (cheating) against the accused.”

He informed both the Sections 409 and 420 cannot be slapped together against any accused.

Senior CBI official said UU Lalit sought to frame charges under Section 409 of IPC without consultation of the probe agency. However, CBI official also accepted that special prosecutor has the rights to do so.
