Justice Manoj Kumar Gupta dismissed petitions of Kamal Singh and 21 others on July 8. They had challenged their transfer orders passed on June 19.
    
The petitioners had contended that with their retirement due within the next two years, they were ‘entitled to be posted in their home district or a district adjoining their home district’ according to the state government's policy dated April 18, 2013. They claimed that their transfer orders violated the government order.
    
However, the state government's counsel said that while the order related to ‘transfer of government servants working in various departments, except the secretariat’ there was a separate transfer policy in place for the police department.
    
It was further contended by the state counsel that there was a bar on policemen being posted in or near their home districts under the separate transfer policy. An amendment brought in on March 20, 2012 had made such postings possible until the earlier rules were restored by a government order on June 7.
    
The court dismissed the petitions concurring with the state's submission.
