Lucknow: The Lucknow bench of Allahabad High Court has given strict directives to the ruling BSP government in Uttar Pradesh to issue notification for the local polls by December 19 or else hand over the responsibility to the state Governor.

A bench comprising Justice Devi Prasad Singh and SC Chaurasia in its crucial verdict on UP local polls cleared that the prime motive of the constitution is to hold independent and fair election which cannot be ignored by the state government. However, if the ruling dispensation carries a negligent attitude in this direction, then it is the responsibility of the Centre to implement Article 355 and 366.

The bench issued directives to Chief Secretary, Principal Secretary Urban Development and district magistrates to conduct local elections in the state along with the State Election Commission.

The court also rejected the amendments made by the state government in 2005 under which the administrator will be directly appointed if state government fails to conduct local poll after five years.  It also prohibited the transfer of executive officers and municipal commissioners without permission of election commission.
