Banda, Jan 21 (JNN): Supreme Court on Friday came down heavily on the CBI and Mayawati Government in Uttar Pradesh as it issued notice to CBI, UP Home Secretary, Banda Superintendent of Police and Banda Jail SP in the Banda rape case.

The apex court’s intervention in the sensational case where a BSP MLA Purshottam Naresh Dwivedi has been accused of raping a Dalit girl and then accusing her of theft which led to her arrest came as a petition was filed before it on Thursday. The petition said that the procedure laid down in the Juvenile Justice (Care and Protection of Children) Act, 2000 for handling cases of juveniles in conflict with law was not followed in the Banda victim's case.

The rape victim who spent about a month in jail, over an allegedly false theft case, was released earlier this month.

MLA’s judicial remanded extended

Meanwhile, a local court extended the judicial remand of Dwivedi and three others.

Additional Chief Judicial Magistrate Sanjiv Kumar Jaiswal extended the remand of Dwivedi, Rajendra Shukla, Surendra Neta and Ravan Garg, who were present in the court.

The CB-CID probing the matter had filed chargesheet in the matter in the court yesterday.

Dwivedi has been charged with Sections 376 (rape), 354 (assault or criminal force to woman with intent to outrage her modesty) and other relevant sections of IPC in the charge sheet filed in Chief Judicial Magistrate Tripta Chaudhary's court. The other three co-accused have also been booked under the charges, except for rape.

FIR against MLA Dwivedi was lodged on Jan 12 and he was arrested on Jan 13.

The Dalit girl was allegedly raped on December 10-11 at the residence of 48-year-old Dwivedi, who represents Naraini seat in the Uttar Pradesh Assembly. She escaped from the MLA's house on December 12 when the MLA allegedly attempted rape for the third time and was arrested same day on theft charges. The issue, which has been rocking the state government for about a month now, has led to the Opposition grabbing every opportunity to slam the government.
