The BJP alleged that Somnath Bharti tried to influence a witness and tamper with evidence the case he handled last year.

CBI Special Judge Poonam A Bamba in August last year had indicted Bharti and his client Pawan Kumar after CBI accused them of trying to influence a prosecution witness by talking to him on phone and discussing the case.

The case relates to Kumar's prosecution by the CBI in his alleged acts of omission and commission while employed with the State Bank of Mysore since 2006. As one of the cases came up for trial, a prosecution witness was recorded in court. During his cross-examination, Kumar through Bharti told the court that he wanted to confront the prosecution witness with an audio conversation and wanted to place the same on record.

The CBI demanded that Kumar be sent back to jail, accusing him and Bharti of influencing a witness and trying to tamper with evidence.  The Patiala court had cancelled Kumar’s bail in the wake of Bharti’s indictment.

Bharti had taken the matter to the High Court and then to the Supreme Court. However, neither court had agreed to grant him reprieve in the matter.
