The High Court's order comes on a petition challenging the measure, terming it as a "fraud" on the Constitution.

The HC also stayed previous Congress-NCP government's decision to provide 5 percent reservation to Muslims in public service. However, the HC has allowed reservation for Muslims in educational institutions.

The PIL had only challenged the reservation for the Marathas. It has urged the court to direct the state government to "recall" the decision.

Four months ahead of Assembly elections in Maharashtra, the Congress-NCP government had announced 16 percent reservation for Marathas and five percent for Muslims in jobs and educational institutions.

The BJP has emerged as the single largest party in Maharashtra after Assembly elections in the state. The saffron party-led by Devendra Fadnavis has formed a minority government in Maharashtra after Shiv Sena decided to warm the Opposition benches in the 288-member Assembly.
