Turning down Jaidev's counter-claim 'not maintainable', Justice RD Dhanuka on Monday said that he will have to file a different kind of application and follow the procedure laid down in the law to make that kind of claim.

According to sources, Jaidev had filed a caveat against his brother Uddhav's probate petition - one that seeks to certify a will.

Along with the caveat, he reportedly filed an affidavit in support of it. It is in this affidavit that Jaidev made a 'counter-claim' to all moveable and immoveable properties owned by his father - something that Uddhav's side opposed during the High Court hearing.

The High Court dismissed the application observing that it was a testamentary court and hence had no jurisdiction to decide on Jaidev's plea.
