New Delhi: Terming the arrest of BJP MLA Rajendra Rathore in the Dara Singh encounter case as unfortunate, the BJP on Thursday said that the investigating agency CBI has degraded its status as an independent agency and acting like a puppet of the Congress which is unabatedly using the agency against the Opposition parties time and again.

“The arrest of the BJP legislator is no more than a political stint. CBI has become a puppet in the hands of Congress. Rathore has been wrongly implicated. His name never appeared during the FIR or chargesheet but as soon as the case was handed over to CBI this happened,” said BJP spokesperson Nirmala Sitaraman soon after Rathore was arrested by the CBI here on Thursday.

Terming the encounter as fake, the investigating agency on Thursday morning arrested and filed chargesheet against BJP MLA and former PWD minister Rajendra Rathore for his alleged involvement in conspiring the fake encounter against the local liquor smuggler.

Dara Singh alias Darius was gunned down by Rajasthan police in an encounter on the outskirts of Jaipur on October 23, 2006. The case took a u-turn after the Congress government came into power in Rajasthan and the Supreme Court ordered a CBI inquiry into the incident.

CBI officials claim that the encounter of Dara Singh was conspired at the behest of a rival liquor gang and top police officers and Rathore were the main conspirators.

Rathore is considered as the man Friday of the former Chief Minister Vasundhara Raje.

Six persons including inspector general of police A Ponnuchami and Additional Director General of police AK Jain are already in judicial custody while the arrest warrant has been issued against eight others.

ADG AK Jain, prime accused in the encounter case was absconding since June 4 last year, had on February 28 surrendered before a special CBI court after which he was remanded to judicial custody.
