Judicial Magistrate Mitali Govind Rao dismissed the complaint against Yadav on Tuesday evening, citing that there was no basis for taking cognizance against him.
The court also refused the complainant's demand of issuing a summon against the SP supremo.
Local activist Virender Singh, who is also an accused in three riot-related cases and is currently out on bail, has filed the private complaint against Mulayam Yadav for his ‘objectionable’ comments made during a reported speech.
The complaint had referred to the ex-Uttar Pradesh chief minister's statement in which he said that his party government will crush communal forces involved in vitiating atmosphere in the state.
Communal clashes had erupted in Muzaffarnagar and adjoining areas of western Uttar Pradesh on September 7, which killed over 60 persons.
