New Delhi/Mumbai: Communist Party of India (CPI) on Thursday said that Supreme Court's judgement on disqualifying lawmakers convicted by a court for two years or more will help in cleansing Parliament and state Assemblies from criminals.

MPs, MLAs to be disqualified on conviction

"This well intentioned move will help to cleanse the Parliament and state Assemblies from convicted criminals who manage to prolong their membership during pendency of appeals in higher court," the party said in a statement.

The Supreme Court on Wednesday struck down the legal provision that protects a lawmaker from disqualification even after conviction in a criminal case. The Apex Court ruled that MPs or MLAs shall stand disqualified from the date of their conviction. The Apex Court held Section 8(4) of the Representation of the People Act (RPA) as ultra vires. The section allows a convicted legislator to remain in office till his or her appeal remains pending.

NCP welcomes SC's verdict on RPA

NCP spokesman Nawab Malik said that this landmark judgement will go a long way in cleansing the political system of criminal elements.

"Whenever there will be a debate in the government or the Parliament on the judgement, NCP will support this ruling," Malik said.
