Jaipur:  Terming the allegations of BJP that the government is misusing CBI in Dara Singh encounter case as baseless, Rajasthan Chief Minister Ashok Gehlot on Friday lashed out at the Leader of Opposition Vasundhara Raje and accused her of creating a caste-divide in the state during her tenure.

"I condemn Leader of Opposition (Raje) for her allegations and also the language in which she was talking on Thursday. Her allegation that the government misused the CBI and has any role in the arrest of Rathore is baseless," Gehlot told reporters on the sidelines of a function here.

"She worked to create caste-divide and provoked people in the name of caste during her tenure," he said.

"This is in her nature and she thinks that others also do the same but we are quite against this," he said.

He said that it was the first of its kind example that a jail-going criminal was glorified and a procession accompanied him to court and to Jail. Gehlot said that there should no interference in the investigation in any case.

"We all should have faith in constitution and judiciary. They people are fascist and do not have faith in law and order," he said.

Terming the encounter as fake, the investigating agency on Thursday morning arrested and filed chargesheet against BJP MLA and former PWD minister Rajendra Rathore for his alleged involvement in conspiring the fake encounter against the local liquor smuggler.

Dara Singh alias Darius was gunned down by Rajasthan police in an encounter on the outskirts of Jaipur on October 23, 2006. The case took a u-turn after the Congress government came into power in Rajasthan and the Supreme Court ordered a CBI inquiry into the incident.

CBI officials claim that the encounter of Dara Singh was conspired at the behest of a rival liquor gang and top police officers and Rathore were the main conspirators.

Rathore is considered as the man Friday of the former Chief Minister Vasundhara Raje.

Six persons including inspector general of police A Ponnuchami and Additional Director General of police AK Jain are already in judicial custody while the arrest warrant has been issued against eight others.

ADG AK Jain, prime accused in the encounter case was absconding since June 4 last year, had on February 28 surrendered before a special CBI court after which he was remanded to judicial custody.
