The resolution was moved on the first day of two-day emergency session convened by the
Aam Aadmi Party (AAP) government.

The session was convened amid Delhi High Court judgment wherein the court noted that Lieutenant Governor is bound to act upon the aid and advice of the Council of Ministers who  are directly elected by the citizens of Delhi and the Centre's "executive fiat" siding with him is "suspect".   

''MHA notification disrespects people's mandate given to the AAP government. It appears the Centre is afraid of the action Delhi government is taking against corrupt officials,'' Sisodia said while moving the motion. The MHA notification is opposite of what is stated in the Constitution, the Deputy Chief Minister added.
