New Delhi: The Delhi High Court on Tuesday dismissed the plea of two 2G case accused who challenged the presence of the CBI investigating officers in the court room during the trial in the case.

“Both the petitions are dismissed as no prejudice would be caused to the accused by the presence of the investigating officials (IO) in the trial court,” Justice M L Mehta said.

While hearing the plea, Justice Mehta underlined that the presence of investigating officials in the court cannot affect the case and levy pressure on the accused.

"I fail to understand as to how any witness would be under pressure by the presence of the IO in the court room. Mere presence of the officials in the court room at the time of recording of statement of any other witness would not be a ground to say that the prejudice would be caused to the accused or the trial to be not fair," Justice Mehta said.

The petitions were filed by Asif Balwa and Rajeev Aggarwal, directors of Kusegaon Fruits and Vegetables Limited.
