New Delhi: A bench of Justices NK Shikri and RS Endlaw of Delhi High Court on Wednesday reserved its order on the plea of Rohit Shekhar and said that veteran politician ND Tiwari cannot be compelled to give the blood sample for his DNA test to decide the youth's paternity suit.

Claiming ND Tiwari as his biological father, Rohit contended that a single judge bench had failed to satisfactorily deal with the high-handed and dismissive conduct of Tiwari. He had further said that it would be difficult for him to get justice, if Tiwari is not compelled to give the blood samples.

On September 23, 2011 a single bench judge in its order had said that the former Uttarakhand Chief Minister cannot be compelled to give his blood samples. However, the court also observed that the denial may be counted as evidence against the minister.

Earlier the court had ordered Tiwari to submit his blood samples for his DNA test to decide the youth's paternity suit. But in June 2011, Tiwari had denied giving blood samples for the test.
