Allahabad: After a split verdict by the division bench over the appointment of Gujarat Lokayukta, the case is now set to be heard by another judge. The case will now be presented to Chief Justice AR Dave, who would further hand over the case to a bench of 3-5 judges.

Justice Sonia Gokani of Gujarat High Court differed with Justice Akil Qureshi’s decision of upholding the appointment of retired Justice RA Mehta as the Lokayukta for the state and asked the state government to appoint a new incumbent in next four months.

The decision of appointing the Lokayukta within 4 months would also put forward to the new judge.

However, the two-judge bench of the High Court has deferred the case of leaking of the letter written by the Chief Minister to Prime Minister Manmohan Singh in connection with Lokayukta.

Gujarat Governor Kamla Beniwal had appointed retired Justice RA Mehta as Lokayukta on August 24 this year without taking Modi government into confidence. Later the Gujarat Government challenged the appointment of Lokayukta in the High Court.
