Fixing October 30 as the next date of hearing in the matter, a division bench of Justice Dinesh Maheshwari and Justice Yashwant Verma asked the state government as well as Noida authorities to file their counter affidavits.
Petitioners Shivraj Singh and 22 other residents of the village had moved the court alleging that their land was acquired vide a fresh notification after the earlier acquisition was set aside by the court in 2011.
Significantly, on October 21, 2011 a full bench of the court had cancelled the acquisition of thousands of hectares of land in the district, spread across a number of villages including Shahberi.
The court had taken exception to the fact that vast tracts of land were acquired in the name of "planned industrial development" of Noida, Greater Noida and Noida Extension townships, but were later handed over to real estate developers for building residential complexes.
