The Lucknow Bench, comprising Justices Uma Nath Singh and Mahendra Dayal, issued notice to Chief Secretary to file an affidavit by Friday. "We are informed that file of petitioner has been sent for the opinion of Advocate General. However, we are also told that the Advocate General has demitted his office on October 18, and till date his successor has not been appointed," the bench said on a writ petition filed by a PCS officer Harishanker Pandey.

"State cannot be run without Advocate General or else it may create a constitutional crises," the court said. AG Surya Prakash Gupta had resigned citing personal reasons on October 18.

Gupta was appointed as the Advocate General on March 18, 2012 immediately after the Samajwadi Party stormed to power in 2012.
