Chandigarh: In a setback to the Haryana Staff Selection Commission (HSSC), a petition has been filed in the Punjab and Haryana High Court challenging the appointment of Chairman and other members of the Commission.

Hissar resident Vikendra Malik has filed a petition in the High Court seeking cancellation of the appointments of members of the Commission alleging that their appointments have been made without following the prescribed rules and regulations.

Citing the information availed from the RTI, Malik has said that the appointment of the current Chairman of HSSC Vijay Kumar has been made through political channels and the correct process has not been followed.

“The Haryana government had set up collegiums for the appointment of the Chairman and after consulting Education Minister Geeta Bhukkal and Chief Secretary Urvashi Gulati, Kumar was appointed for the post,” said the petitioner.

Other members including Vinay Sharma, Ashok Kumar Jain, Ram Saran Bhola were also appointed in the Commission following the recommendation of the collegiums.

The petitioner has further alleged that the government did not invite open application for the post and didn’t even follow the guidelines prescribed by the previous HC bench.

Notably, a High Court bench has issued set of guidelines for appointments to  constitutional posts last year. In the guidelines, the HC has asked the state to form a three member committee under the chairmanship of chief secretary and principal secretary as the other member.

The third member can be in service or retired official but must be at the Finance Secretary level or of Brigadier rank in armed forces. The panel would review the applications and select the appropriate candidature for the constitutional posts.

The candidates recommended by the panel will be further reviewed by a high-power committee constituted by Chief Minister, Assembly Speaker and Leader of Opposition in the Assembly.  The final decision on the selected candidates will be taken by the Governor.
The HC had also asked to keep the complete records of the appointment process.
