Ranchi: While dismissing the election petition filed by BJP's Ram Ji Lal Sharda challenging the 2009 Hatia assembly election results, the Jharkhand High Court on Friday paved the way for the by-poll which was on hold due to the objections of the BJP leader regarding the poll results.

Terming the government’s reply on the issue ‘satisfactory’, the bench of Justice RK Merathia described the petitioner’s move as ‘unjustified’ and ‘against the law’.

The petitioner in his plea had demanded re-counting of votes after he lost the election against Congress MLA Gopal Sharan Nath Shahdeo by 25 votes in 2009 assembly elections.

However, the court dismissing his plea stated that there is zero probability of forging in the counting of votes.

The seat was vacant after the demise of Congress MLA Gopal Sharan Nath Shahdeo on June 28, 2010. Sharda had filed the petition soon after the result was announced on December 25, 2009.
