New Delhi:In a bid to avoid the ignominy of becoming the first judge to be impeached by the Parliament, Justice Soumitra Sen of Kolkata High Court tendered his resignation. Not wanting the Lok Sabha to take up impeachment motion against him,Justice Sen faxed his resignation to President Pratibha Patil on Thursday.
 
It is assumed that impeachment motion moved against him would lapse after his resignation.

The Rajya Sabha has already passed the motion against him, making him the first judge to have been impeached by the Upper House for misconduct.


In an interview to Dainik Jagran he said, “I have decided not to go to the Lok Sabha and therefore, have tendered resignation.” He further stated that he has sent a copy of resignation to Lok Sabha Speaker Meira Kumar.

His lawyer Subhash Bhattacharya in his letter to President Patil informed that since the Rajya Sabha has taken a decision to remove him from the post, he is offering resignation and would like to live like a common man.

Earlier,a Committee appointed by the Rajya Sabha Speaker found him guilty of misconduct.

In a similar case,Chief Justice of Sikkim High Court PD Dinakaran had also tendered his resignation.

Legal views sought on resignation

A legal suggestion will also be sought from Attorney General of India, Goolam Vahanvati, in this regard.

According to sources in the Parliament, chances are high that the President will repeal the resignation tendered by Justice Sen.
