An Apex Court bench headed by Justice BS Chauhan issued notice after NGO Naaz Foundation urged it to issue directions that HIV positive school children should not be discriminated against and turned out of the schools.

In a PIL filed in the Apex Court, the NGO said that a right to get free and compulsory education under RTE act has failed to be of any significance for scores of HIV positive children. These children are either refused admission or being segregated by schools, both private and government, it claimed.

The Naaz Foundation urged the SC to secure these students against further discrimination. It said that HIV positive children should be treated as "disadvantaged".
