“There have been procedural lapses by the Tamil Nadu government in its decision to release seven convicts in Rajiv Gandhi assassination case,” a bench headed by Chief Justice P Sathasivam, Solicitor General Mohan Parasaran observed.

The Apex Court also issued notice to the state government and asked it file reply within two weeks. The top court posted the matter for further hearing on March 6.

“Appropriate government has power to remit sentence but it has to follow the laid down procedure,” the bench said.

The Centre had filed a plea against the Tamil Nadu government's decision to release all seven convicts in Rajiv Gandhi assassination case.

On Wednesday, the Tamil Nadu government decided to set free all seven convicts in the assassination case after the Apex Court had commuted the death penalty of three of them to life imprisonment.
