Mumbai: A fast-track court on Wednesday convicted Bollywood actor Shiney Ahuja for raping his maid and sentenced him to seven years' rigorous imprisonment (RI). The actor was also fined Rs 3,000 by the court.

On September 3 last year, the victim had identified Shiney in the court and said she used to work at his residence as a domestic help. But when asked about the incident, she said she was never raped.

However, the court acquitted Ahuja of the charges of criminal intimidation and wrongful confinement, Public Prosecutor Kashinath Dighe told reporters who were not allowed in the court as the proceedings were in-camera.

Convicting the accused, the court said it had considered circumstantial evidence -- the DNA report was positive, the hymen was torn, there were blood marks on victim's clothes, semen was found on quilt and curtains and Shiney's hand bore scratch marks of the victim.

The court also noted that the 2009 incident had occurred at Shiney's house here, the victim's clothes were torn and there was evidence to show that she had struggled. It also accepted her statement before a Magistrate alleging she was raped, Dighe said.

After the conviction, the Judge asked Shiney what he had to say about the quantum of sentence. The actor pleaded for leniency, saying he had a family to look after and a career to pursue.

The prosecution, however, sought life imprisonment or ten years RI for the convict. The court then sentenced him to seven years RI.

The police, in a 109-page chargesheet, had charged Shiney with rape and wrongfully confining the victim. Shiney, in his defence, had argued that he was falsely implicated.

Meanwhile, Additional Commissioner of Police, Amitabh Gupta, who supervised the probe into the rape case, said the convincing evidence police collected had proved the role of the actor in the crime despite the victim turning hostile. 

"We are happy that the accused in the case was convicted," he said.

They had convincing evidence including forensic evidence, the IPS officer said, adding, "We had left no loopholes in the probe. Despite the victim turning hostile we managed to prove our case in the court."

Police had gathered the DNA report and the medical report, which confirmed the rape by Shiney. The investigating officials also recorded the statements of 12 witnesses and gathered other documentary evidence, said another police officer.

The victim in her complaint to police had said that she and the actor were alone in the house when Shiney raped her. The maid had alleged that Shiney had confined her to his bedroom for hours before allowing her to go.

Once she was allowed to go, she told her aunt about the incident who then took her to the Oshiwara police station to lodge the complaint, the girl had said.
