Lucknow: Uttar Pradesh Assembly on Monday passed a bill extending the tenure of Lokayukta and its deputy to eight years and making provision for fine of up to Rs 50,000 in case of a false complaint.

Earlier, the term of Lokayukta and deputy Lokayukta was for a period of six years, but it was extended to eight years by the government through an ordinance in March.

Provision of fine of upto Rs 50,000 has been made in the UP Lokayukta and Deputy Lokayukta (Amendment) Bill in case a false complaint is lodged against any public servant with the Lokayukta.

As per the bill, the term of Lokayukta and deputy Lokayukta would be for a period of eight years from the date of assuming the office.

A restriction has been imposed that the Lokayukta and deputy Lokayukta would continue on the post till the time new appointment is made.

Besides, the Lokayukta could resign from the post or could be removed from the post as per the provisions of the Act.

According to the bill, security money to be deposited by the complainant has been increased to Rs 2000 from existing Rs 1000.

The bill states that during investigation if Lokayukta or deputy Lokayukta is satisfied that the complaint is filed with malafide intention or with an objective of insulting any public servant then the investigation would be closed and a fine upto Rs 50,000 could be imposed on the complainant.

If the complainant fails to deposit the fine within two months of the order, then it would be realised like land revenue from his property through the district magistrate.

Besides, if Lokayukta or deputy Lokayukta is satisfied that injutsice was done with the public servant or he has been defamed due to false complaint then he may give compensation to the affected employee which would not exceed the fine amount.

Earlier, in March the government issued an ordinance extending tenure of Lokayukta Justice N K Mehrotra with effect from March 15, the day his term was scheduled to end.

The bill says that as the term of Justice Mehroatra ended on March 15 and it was not possible to make a new appointment immediately, it was decided to extend the term of Lokayukta and deputy Lokayukta from six years to eight years.

"As the Vidhan Sabha was not in session and immediate legislative action was needed UP Lokayukta and Deputy Lokayukta (Amendment) Ordinance was promulgated by the Governor in March 22," it said.
