Allahabad: Terming it unconstitutional, the Allahabad High Court cancelled rule 4 (2) of the Uttar Pradesh Municipalities Rules-2010, conducting elections of members, Chairmen and Mayors.

After the court’s order, elections of the local bodies will be held according to the old rules only. This has come as a jolt to the UP government as it had amended the rule stating that no local body would contest the election on party banner or symbol.

The high court said it was contrary to the spirit of constitutional amendment. The state government will approach the Supreme Court in this matter.

A bench comprising Chief Justice FI Rebello and Justice AP Sahi ordered restoration of the old practice after a petition was filed by People’s Union for Civil Liberties (PUCL) and an advocate Abdul Jabbar.

PUCL advocate RK Jain, Shamim Ahmed on behalf of Jabbar and the state government’s additional advocate Jaideep Mathur debated on this matter.
